The Advertising Standards Council of India (ASCI) is committed to ensuring the protection of
personal information. This document explains ASCI’s policies for the collection, use and
disclosure of personal information.

How personal information is collected

ASCI may collect personal information from multiple sources which shall be inclusive of
but not be limited to

  • website visits of user;
  • any related ASCI website, social media page, WhatsApp number, intranet and any ASCI
    mobile or tablet application; .
  • information provided by the user orally, physically or electronically.

What personal information is collected

The types of personal information we collect include name, email address, phone number(s), postal address, professional details, organisational details, social media profiles, complaint details, information that we may collect about your individual preferences and information required for processing your complaint. Personal information will not be collected from any person who is known by ASCI to be under the age of eighteen (18) without the consent of a parent or legal guardian.

How personal information is used and who we share this personal information with

In the context of our activities, we may use the personal information collected for the following purposes:

  • services and responding to enquiries: Personal information may be required to provide you with information and access to services that you have requested from ASCI or which ASCI feels may be of interest to you. We also collect personal information to prevent misuse of our forum.
  • Submitting a complaint to ASCI’s self-regulatory network: ASCI may administer a complaint on an advertisement received by phone, email, or via its website and other ASCI channels.

ASCI will inform you before collecting personal data if it intends to disclose your information to any third party [K1]. ASCI may provide personal information to sub-contractors and professional advisors (which shall be bound by privacy obligations) to assist ASCI uses disclosed herein.

Security

Personal Information is stored in a combination of physical copies and electronic files. They are protected by appropriate security measures to prevent unauthorized access, disclosure, modification, or destruction of this data. ASCI shall take reasonable steps to ensure that the personal information it holds is accurate and up to date. Please assist us in keeping your information as accurate as possible by informing us, ideally by email, whenever changes in your personal data need to be reflected in our records.

Cookies

Cookies are used by ASCI for the convenience of our users. Cookies automatically authenticate the user. A user can access ASCI Website with a cookie feature turned off; however, in doing so they may find themselves challenged for tracking id, username and password information on multiple occasions. ASCI uses Google Analytics to gather statistics for portions of our website. We will use this information to improve user interfaces and web services for visitors. Social media and video

ASCI keeps a record of information from its social media platforms, which may include contact information provided by following us on Twitter or LinkedIn, in any feedback or comments to any posts on our Facebook page, LinkedIn page or Twitter account (@ASCIONLINE), or by ‘liking’ ASCI’s page on Facebook. If you choose to share our digital content through social networks, such as Facebook, Twitter and LinkedIn, or to watch a video posted on a third-party media site (such as YouTube), you may be sent cookies from these third-party applications. ASCI does not control the setting of these cookies; we request you to check the third-party websites for more information about how to manage their cookies.

Changes in the privacy policy

This Privacy Policy may be subject to updates or amendments, which will be made available on the ASCI website. We encourage you to periodically review it to ensure that you are still happy with it.

ASCI Terms of Use

The Advertising Standards Council of India (ASCI) collects personal information about you from multiple sources as specifically described in our Privacy Policy. We use the term “Personal Information” to refer to any information you provide in connection with your use of our Website by which you can be personally identified. ASCI shall ensure that the personal information/data it collects and holds is adequate, relevant and limited to what is necessary in relation to the purposes for which data is processed.

Our Websites may also collect and use passively collected anonymous information or personal information from various third party sources and may combine this anonymous information or personal information with other personal information collected from you, to provide better service to Website users, customise a Website based on your preferences, compile and analyse statistics and trends, and otherwise administer and improve its Websites for your use. How data is stored and maintained

ASCI maintains records of your personal data in its information technology system and takes appropriate security measures to prevent unauthorised access, disclosure, modification, or destruction of this data. ASCI also maintains personal data in various documents such as attendee lists and meeting minutes.[K1]

The ASCI Secretariat and relevant partners who may have access to your data in order to provide services to ASCI (e.g. web hosting and software providers, external auditor) are contractually obliged to keep such information in confidence and may not use these data for any other purpose than performing their contractual missions for ASCI.

ASCI takes steps to protect your information from unauthorised access and against unlawful processing, accidental loss, destruction and damage. We will only keep your information for as long as we reasonably require and, in any event, only for as long as data protection legislation allows.We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Policy and the applicable Data Protection Legislation.

Disclosure to third parties

Our policy is to not sell, rent, lease, provide or otherwise disclose your Personal Information to unaffiliated entities unless otherwise described in this Privacy Policy. Notwithstanding the foregoing, we may disclose your Personal Information to any Third Party we engage for the purpose of administering, operating, configuring site design, maintaining and providing internal support for our Websites and Content. These Third Parties are called “operational service providers,” and they provide internal support to operations and activities and/or for Site design, development, hosting and operations.

We work with sponsors, advertisers, government agencies, and other Third Parties to bring you public service advertising and if you enter, provide or submit Personal Information on or to a co-branded website or web page you may be subject to the terms, conditions and privacy policies of the Third Party sponsor, advertiser, government agency or co-branding organisation.

Password security

Access to the ASCI Members Area may involve you giving a password and account designation. You are responsible for maintaining the confidentiality of the password and account ASCI provided you with and are fully responsible for all activities that occur under your password or account. You agree to:

  • immediately notify ASCI of any unauthorised use of your password or account and any other breach of security;
  • ensure that you exit from your account at the end of each session. ASCI cannot and will not be liable for any loss or damage arising from your failure to comply with this obligation.
