The ASCI had approached the advertiser for its response in addressing the grievances of the complainant and forwarded the details of the complaint, verbatim, to the advertiser with a request to respond to the same. The advertiser was offered an option to seek an Informal Resolution (IR) of the complaint by modifying or withdrawing the claims in the advertisement. The advertiser was also offered an opportunity for a telecon with the ASCI Secretariat, which they did not avail and neither did they submit their written response. The Consumer Complaints Council (CCC) viewed the Instagram advertisement (https://www.instagram.com/p/DJtf-O0xHRx/) and considered the complaint. The CCC noted that no response was received from the advertiser prior to the prescribed due date as specified by the ASCI Secretariat. In the absence of a response from the advertiser, the CCC concluded that the claim, “Toppers always from Motion Academy”, was not substantiated with supporting data. Claim, “JEE Main – 2025 Result (110 students selected for Advanced Exam 2025)”, was not substantiated with supporting data showing enrolment of students, the number of students who appeared for JEE Main 2025, and the number of students selected for the Advanced Exam 2025. The CCC observed that the advertisement highlights a student as “Agra Topper” but does not provide information about the nature of the student’s association with the advertiser’s academy, such as whether the student was enrolled in a full-time classroom program, an online course, or participated only through a test series. This omission makes the claim attributing the student’s success solely to the institute which was not substantiated. The claims are misleading by exaggeration. The said claims in the advertisement contravened Chapter I, Clauses 1.1 and 1.4 of the ASCI Code. This complaint was UPHELD.
