The ASCI had approached the advertiser (Samast Technologies Private Limited) and the influencer (Rajan Jayasawal) for their respective responses in addressing the grievances of the complainant and forwarded the details of the complaint, verbatim, to the advertiser and the influencer with a request to respond to the same. They were also offered an opportunity for a telecon with the ASCI Secretariat which they did not avail, and the advertiser and the influencer submitted their response. The advertiser replied that this advertisement was not posted by Magicpin. The influencer stated that it was not a paid promotion. The Consumer Complaints Council (CCC) viewed the LinkedIn post (https://www.linkedin.com/posts/rajan7k_budget-magicpin-budget2025-activity-7291417521818087424- GcXS/?utm_source=share&utm_medium=member_android), considered the complaint, and the response from the advertiser and the influencer. The CCC observed that the LinkedIn post is not a paid promotion, as stated by the influencer. The CCC also acknowledged the advertiser’s response, clarifying that the advertisement was not posted by them. This indicates that there is no material connection between the advertiser and the influencer. Based on these observations, the CCC concluded that the LinkedIn advertisement is not in contravention of ASCI Guidelines for Influencer Advertising in Digital Media. This complaint was NOT UPHELD. The CCC noted that post receiving the complaint, the influencer has updated the LinkedIn post by including a disclaimer at the beginning of the advertisement.
