Damehealth Associates Private Limited - Damehealth Men's Fertility Boost Tablets

Recommendation: Upheld | Medium: Suo Motu - NAMS (TAMS)

The CCC observed that the advertiser has provided a Literature Review on `Mens Fertility Boost’ as claim support data. The claims presented are positioned as if they apply to the product as a whole, giving the impression that the product formulation has been clinically tested and provven to deliver the specific benefits claimed. However, no clinical studies on the final product were submitted. The advertiser has relied on substantiation related to individual ingredients but has not clearly communicated that the functional benefits are attributable to these ingredients rather than the finished product. The CCC further observed that the advertiser has not provided the specific amount of individual ingredients used in the product, nor evidence demonstrating that these quantities included correspond to those shown to be effective in the cited studies. Additionally, no evidence was submitted to confirm that the product contains these ingredients at levels equivalent to those proven effective in the scientific research. Based on these observations, the CCC concluded that the claims, “Fuel your fertility with a triple-action formula: Boost testosterone naturally, Elevate sperm count & volume, Improve motility & structure”, were inadequately substantiated. The claims are misleading by exaggeration and are likely to cause widespread disappointment in the minds of consumers. The source and date for the claims is not mentioned in the advertisement. The said claims contravened Chapter I, Clauses 1.1, 1.2, 1.4 and 1.5 of the ASCI Code, and ASCI Guidelines on Advertising of Foods & Beverages (F&B). This complaint was UPHELD. The CCC noted the advertiser’s response that the said Facebook advertisement has been withdrawn.
