Recommendation: Not Upheld | Medium: Consumer Organization
The ASCI had approached the advertiser for its response in addressing the grievances of the complainant and forwarded the details of the complaint, verbatim, to the advertiser with a request to respond to the same. The advertiser was offered an option to seek an Informal Resolution (IR) of the complaint by modifying or withdrawing the claim in the advertisement, or alternately to substantiate the claim with supporting data. The advertiser was also offered an opportunity for a telecon with the ASCI Secretariat, which they did not avail and submitted their response. The advertiser in their response stated that the claim is intended to convey that the `MG Windsor EV’ is the highest selling electric passenger vehicle model in India on a national basis during the relevant sales periods, based on industry standard national sales data. The phrase “best selling EV” is made in comparison with other EV models in the passenger vehicle segment nationally. The claim is substantiated through national model-wise sales data compiled and published in the SIAM Flash Reports. As claim support data, the advertiser provided the following documents – (1) SIAM publications web portal reference, (2) Industry reports from SIAM Flash for 2025, (3) Comparative EV sales/ranking table based on SIAM data, (4) Supporting material demonstrating SIAM data’s credibility through citations by reputed publications. In response to ASCI’s queries, the advertiser provided the month-wise domestic sales breakdown of the `MG Windsor EV’ from the commencement of sales, extracted from internal records maintained by them. The advertiser stated that the claim is based on the SIAM Flash Reports (Model-wise and Fuel-wise Data of Passenger Vehicles and Three Wheelers). These SIAM extracts confirm that MG Windsor EV maintains Rank 1 in the electric passenger vehicle segment on a model-wise national sales comparison. The advertiser submitted the following data – (1) Month-wise domestic sales data from internal records, (2) SIAM Flash Report extracts for March 2025 and November 2025, (3) Comparative EV sales/ranking table, (4) Public-domain references supporting SIAM data credibility and MG Windsor EV’s market position.
The advertiser’s response with the claim support data was referred to an independent technical expert of ASCI for their opinion. The expert opinion was then shared with the advertiser to allow them to make additional submissions. In response to the expert’s opinion, the advertiser responded stating that within the Indian automotive industry, the universally accepted and authoritative metric for reporting, ranking, and benchmarking vehicle sales is SIAM wholesale data (primary sales from OEM to dealer), which constitutes the established gold standard for industry performance assessment. The advertiser then held a zoom meeting with the ASCI Secretariat and the technical expert to discuss their submissions. Following this meeting, the advertiser responded to the queries raised by the expert and the discussions held during the meeting. They further provided a certificate from an independent CA for sales numbers of `MG Windsor EV’.
The additional submissions made by the advertiser were shared with the technical expert for final opinion. The Consumer Complaints Council (CCC) viewed the print advertisement, considered the complaint, the advertiser’s response along with the claim support data, and the expert’s final opinion presented at the meeting. The CCC observed that the advertiser provided month wise domestic sales data along with industry sales data sourced from SIAM. The claim was examined in the context of national sales performance and comparative ranking within the electric passenger vehicle segment. The CCC further observed that the certification issued by a Chartered Accountancy firm reviewed the relevant sales data and confirmed that MG Windsor recorded higher sales volumes than competing models during the relevant period. Based on the comparative industry data and the independent verification submitted, the CCC concluded that the claim, “India’s Best-Selling EV Turns One”, was substantiated. The said claim is not in contravention of Chapter I of the ASCI Code. This complaint was NOT UPHELD.
