The ASCI had approached the advertiser for its response in addressing the grievances of the complainant and also forwarded the details of the complaint, verbatim with a request to respond to the same. The advertiser was offered an option to seek an Informal Resolution (IR) of the complaint by modifying or withdrawing the claims on the product packaging, or alternately to substantiate the claims with supporting data. The advertiser was also offered an opportunity for a telecon with the ASCI Secretariat, which they availed and the advertiser clarified that the image forming the subject of the complaint is not related to their company and that the company mentioned in the communication is not associated with them.
The ASCI Secretariat sought clarification from the advertiser on its company name, noting that the product under complaint appeared on the advertiser's website and on an e-commerce platform with the company details mentioned therein. The advertiser was requested to respond; however, no response was received within the given timelines.
The Consumer Complaints Council (CCC) viewed the product packaging, considered the complaint, and the advertiser’s response.
The CCC noted that the advertiser did not provide supporting data for the claims made.
In the absence of claim support data, the CCC concluded that the claims appearing on the pack, “To prevent and Improve Lock Jaws”, and “Heals tonsilitis”, were not substantiated. The claims are misleading by exaggeration and are likely to lead to widespread disappointment in the minds of consumers. The said claims contravened Chapter I, Clauses 1.1, 1.4 and 1.5 of the ASCI Code. This complaint was UPHELD.
