The ASCI had approached the advertiser (Nxtquantum Shift Technologies India Private Limited) and the influencer (Rajesh Kumar) for their respective responses in addressing the grievances of the complainant and also forwarded the details of the complaint, with a request to respond to the same. The advertiser and the influencer were also offered an opportunity for a telecon with the ASCI Secretariat, which the advertiser availed. The advertiser and the influencer submitted their response. The advertiser clarified that they have not engaged, commissioned, or authorized the influencer to promote, advertise, or represent their brand in any capacity. They further provided a signed declaration confirming that there is no association with the influencer in relation to the advertisement. The influencer informed that the Twitter post has been modified. The Consumer Complaints Council (CCC) viewed the X (Twitter) post (https://x.com/therjrajesh/status/2059640539763679636) considered the complaint, and the advertiser’s and the influencer’s response. The CCC noted that the influencer has modified the Twitter post to add a disclosure label. The CCC further observed that the advertiser had no connection with the influencer for which they submitted a declaration confirming the absence of any material relationship with the influencer. Based on these observations, the CCC concluded that the advertisement is not in contravention of ASCI Guidelines for Influencer Advertising in Digital Media. This complaint was NOT UPHELD.
