The ASCI had approached the advertiser for its response in addressing the objections raised in the complaint. The advertiser was offered an option to seek Informal Resolution (IR) of the complaint by modifying or withdrawing the claims objected to in the advertisement, or alternately to substantiate the claims with the required supporting data. The advertiser was also offered an opportunity for a telecon with the ASCI Secretariat, which they did not avail nor did they submit their written response. The Consumer Complaints Council (CCC) noted that no response was received from the advertiser prior to the prescribed due date for this complaint. The CCC viewed the digital video advertisement (http://youtube.com) and observed that the advertiser is promoting their food product-True Basics Omega-3 Fish Oil. Advertiser did not provide any specific information for the product such as copy of Product approval license, Product label, Product composition details, and FSSAI approval for the claims made in the advertisement. Upon careful consideration of the complaint, and in the absence of response from the advertiser, the CCC concluded that the claims, “Triple Strength” was not substantiated with comparative test reports. Claim, “Improving Brain Function and Preventing Eye Damage” was not substantiated with clinical evidence of product efficacy. The claims are misleading by exaggeration and are likely to lead to grave disappointment in the minds of consumers. The digital video advertisement contravened Chapter I, 1.1, 1.4, and 1.5 of the ASCI Code. This complaint was UPHELD.
