The ASCI had approached the advertiser for its response in addressing the grievances of the complainant and forwarded the details of the complaint, verbatim, to the advertiser with a request to respond to the same. The advertiser was offered an option to seek an Informal Resolution (IR) of the complaint by modifying or withdrawing the claim in the advertisement. The advertiser was also offered an opportunity for a telecon with the ASCI Secretariat, which they availed and acknowledged ASCI’s communication. However they did not submit their response within the given timelines. The Consumer Complaints Council (CCC) viewed the digital mobile app advertisement and considered the complaint. The CCC observed that no response was received from the advertiser prior to the prescribed due date as specified by the ASCI Secretariat. The CCC observed that the More Retail app listed `Sunfeast Dark Fantasy Choco Fills Cookies Biscuits’ as 600 g / 48 packs, while the product actually delivered was only 471.5 g / 38 packs. The CCC noted that the listing is misleading as it exaggerates the quantity, creating an expectation of more product than was supplied and influencing a consumer’s purchase decision. Based on these observations, and in the absence of response from the advertiser, the CCC concluded that the claim offer,`Sunfeast Dark Fantasy Choco Fills Cookies Biscuits - 600 g / 48 packs. (Rs.187)’ is misleading, and is likely to lead to widespread disappointment in the minds of consumers. The said claim in the advertisement contravened Chapter I, Clauses 1.4 and 1.5 of the ASCI Code. This complaint was UPHELD.
