The ASCI had approached the advertiser for its response in addressing the grievances of the complainant and forwarded the details of the complaint, verbatim, to the advertiser with a request to respond to the same. The advertiser was offered an option to seek an Informal Resolution (IR) of the complaint by modifying or withdrawing the claims in the advertisement or to alternately substantiate the claims with supporting data. The advertiser was also offered an opportunity for a telecon with the ASCI Secretariat, which they did not avail, and replied seeking for an extension of 15 days to submit their response. The deadlines stipulated by Consumer Complaints Council (CCC) procedure exist keeping in mind the immediate and widespread impact that advertisements have on the public. Consequently, any action which is needed to be taken with respect to the same is required to be prompt and urgent. It is for this purpose that the deadlines, as stipulated, are set for advertisers/broadcasters etc, and the CCC itself makes it a priority to deal with every complaint before it as expeditiously as possible. However, as a special gesture, the advertiser was granted an extension of additional five business days to respond. The advertiser in their response stated that, “One Healthcare Solution" refers to our unified digital platform designed to streamline the delivery and management of healthcare services for all types of employees. The decision regarding which plan is offered to each class of employees - whether permanent, contractual, freelance, or interns— is made solely at the employer's discretion. The figure of Rs.145 refers to the entry-level Onsurity membership tier that includes a combination of wellness and a group health insurance policy that covers inpatient hospitalization”. The advertiser had a telecon with the ASCI Secretariat to discuss their submissions. The Consumer Complaints Council (CCC) viewed the Instagram advertisement (https://www.facebook.com/ads/library/?id=1205295034493730), considered the complaint and the advertiser’s response. Claim – “All Employees, One Healthcare Solution: Permanent, Freelancers, Contractual, Interns” The CCC observed that the advertiser has clarified that the term, "All Employees", refers to the inclusivity of Onsurity’s platform, which enables employers to offer healthcare benefits to various categories of workers, including permanent staff, freelancers, contractual workers, and interns. The term, "One Healthcare Solution", refers to a single digital platform that helps employers manage and deliver healthcare services for all these employee types. The CCC noted that the investment plans made available by the advertiser are accessible to all categories of employment; however, the final decision regarding the selection of plans rests with the employer. Employers have the flexibility to offer the same or different plans to various employee groups based on internal policies and organizational needs. The advertiser only provides the platform and does not take part in deciding how plans are assigned. Claim – “Monthly Plans at just Rs. 145 per employee” The CCC noted that the advertiser has clarified that the Rs.145 monthly plan refers to the entry-level Onsurity “Onyx Plan”, which combines wellness services and a group health insurance policy covering inpatient hospitalization with a sum insured of ₹1,00,000 per employee. The plan includes teleconsultations with general physicians and specialists, discounts on diagnostics, health check ups, and medicine orders, as well as emergency care under inpatient insurance. The plan is available to registered businesses with at least three employees, and all enrolled employees receive uniform benefits. Employers may customize or upgrade the plan as needed. There are no hidden charges, and the Rs.145 is the base pricing tier. The hospital network is managed by the IRDAI-registered insurance partner and may be revised periodically. The CCC further noted that the advertiser has submitted that a significant number of corporates were enrolled under the said plan. Based on these observations, the CCC concluded that the claims, “All Employees, One Healthcare Solution: Permanent, Freelancers, Contractual, Interns”, and “Monthly Plans at just Rs. 145 per employee”, were not objectionable. The said claims are not in contravention of Chapter I of the ASCI Code. This complaint was NOT UPHELD.
