The ASCI had approached the advertiser for its response in addressing the grievances of the complainant and forwarded the details of the complaint, verbatim, to the advertiser with a request to respond to the same. The advertiser was offered an option to seek an Informal Resolution (IR) of the complaint by modifying or withdrawing the claims in the advertisement, or alternately to substantiate the claims with supporting data. The advertiser was also offered an opportunity for a telecon with the ASCI Secretariat, which they did not avail and submitted their response. The advertiser stated that their SmartGRID technology is protected by a valid Japanese patent. As claim support data, the advertiser provided a copy of the Japanese patent certificate. The Consumer Complaints Council (CCC) viewed the Facebook advertisement, considered the complaint, and the advertiser’s response. The CCC observed that with respect to the claim, “Japanese Patented SmartGRID Technology”, the advertiser has clarified that it pertains to a valid Japanese patent covering the proprietary grid structure used in their SmartGRID® Mattress, which offers advanced pressure relieving and adaptive support features. The reference is to a patent granted in Japan and does not imply registration in India. In support, the advertiser has submitted a certified copy of the Japanese patent certificate. Based on the supporting evidence provided by the advertiser, the CCC concluded that the said claim was substantiated and is not in contravention of Chapter I of the ASCI Code.
