The ASCI had approached the advertiser Casagrand Premier Builder Limited for their response in addressing the objections raised in the complaint. However, in the absence of response prior to the due date, the matter was examined by the Consumer Complaints Council (CCC) on the basis of the materials available then and an exparte decision was taken. The complaint was Upheld as the claim was not substantiated. Upon receiving the CCC’s recommendation, the advertiser requested for a re-examination of the recommendation. As claim support data, the advertiser clarified that their SellAssure and RentAssure teams have been operational since 2021, serving 163 customers for resale and 628 customers for rentals in the last financial year alone, all within the advertised timelines and also provided with a customer list certified by a Chartered Accountant as an evidence. The advertiser explained that rental and sale prices are entirely determined by the customers themselves, and Casagrand's sole role is to identify a suitable tenant or buyer within 2 months and 6 months respectively, making the question of how income is "calculated" irrelevant. Sample application forms were also submitted to demonstrate that terms and conditions are agreed upon directly between the customer and Casagrand at the time of application. Casagrand further clarified that they do not hold copies of the final sale or rental agreements, as these are executed independently between the property owner and the tenant or buyer. The CCC viewed the television advertisement, considered the complaint, the advertiser’s response along with the claim support data presented at the meeting. The CCC observed that the advertiser has submitted a customer list who have opted for SellAssure and RentAssure programmes in the last financial year which was certified by a Chartered Accountant. The CCC also observed that the advertiser also submitted sample application forms that demonstrated that terms and conditions agreed upon directly between the customer and advertiser at the time of application. Based on the above the CCC concluded that the claim “Guaranteed rental in 2 months and guaranteed resale in 6 months.” is not in contravention of Chapter I of the ASCI Code. This complaint was Not Upheld on Re-Examination.
